Vodacom “Back to Business with Vodacom Business” Promotion

Terms And Conditions

Vodacom (Pty) Ltd (“Vodacom”) is running the Vodacom “Back to Business Expect more with Vodacom Business” Promotion (the “Promotion”) where customers will receive spend vouchers from participating partners when purchasing selected qualifying handsets/ tablets on selected tariff plans from 07 January 2019 to 06 March 2019.   

All Customers during the term of the Promotion agree to be bound by the following Terms and Conditions:

Duration

1. The Vodacom spend voucher offer is only open to Vodacom post-paid customers who either sign up to a new 24-month contract or upgrade to selected tariffs/ plans / selected Fixed Broadband Connect Wireless Lite deals from 09h00 on 07 January 2018 to 23:59 on 06 March 2019 (the “End Date”).

2. The duration of the Vodacom Postpaid Back to Business Expect more with Vodacom Business Promotion may be extended or curtailed at the discretion of Vodacom.

Prizes

3. Qualifying Customers who sign up / upgrade on a RED Professional+, RED Executive+ tariff or Broadband Connect Wireless Lite 100GB plan during the promotional period will receive a R5000 kulula.com travel voucher only:

3.1. R5000 kulula.com travel voucher:

- Customer to claim the voucher within one (1) calendar year.

- Customer must book within 3 years after pin code is issued, and travel within 6 months after pin code is issued via SMS. 

- Flights are for local destinations within South Africa only, on any 1 [one] of the national kulula.com prescribed flight routes.

- All bookings must be made directly with the kulula work head office on details that will be provided via SMS to qualifying customers, at which point the customer will provide the kulula work head office with their Comair voucher code. All bookings are based on availability at time of booking and can only be made via the kulula work head office and no other channel. Once the Comair voucher has been received by the customer, they will be required to phone the kulula work head office to book their flight. The kulula work contact number will be provided to the customer when they have received their Reward voucher via SMS. 

- All bookings must be made 4 [four] weeks prior to the departure date. 

- The person traveling must be the person who purchases any of the products listed in paragraph 5 above and the Reward cannot be transferred or exchanged for cash.                                                                                                             

- Only one Comair voucher may be used per booking.

- Flights are subject to limited availability. In the event that dates requested are not available, the participant will be required to provide alternative dates.

- This Reward operates on an e-ticket system and presentation of an ID document will be required when checking in.

- Any additional charges over and above the value of the customer’s voucher or arising from additional passengers will be for the customer’s own account.

- Should the full value of the voucher not be used for the booking, the customer will forfeit the remaining value of the voucher.

- Should the value of the flight ticket be more than the value of the Comair voucher, the customer will be liable to cover the additional cost of the flight ticket 

- Cancellations or flight changes after confirmation of booking will not be permitted. 

- Vodacom its agencies cannot be held liable for any changes to flight schedules, routes and destinations or loss of baggage.

- Comair vouchers codes cannot be used in conjunction with any other promotional Rewards.

- Comair vouchers are subject to Comair’s regular terms and conditions, which are subject to change, unless otherwise specified in this section.

- Customer must reside in South Africa and be in possession of a valid SA identity document and/or a valid permanent residence permit. 

- Customer must be eligible to travel, have no criminal warrant, and/or health issues that prohibit them to travel locally.

4. Qualifying Enterprise Customers who sign up / upgrade on BroadBand Connect Wireless Lite 50GB plan during the promotional period will receive a R1000 Takealot.com coupon only:

• Customer to claim the coupon within one (1) calendar year and use the coupon within three (3) years

• Each Coupon can only be used once at checkout.

• Only one Coupon can be used per order

• The value of the Coupon will be set off against the value of the shopping basket and the balance remaining, if any, will be payable by Coupon holder

• If the full value of the Coupon is not used, the Customer will forfeit the remaining value of the Coupon.

• Coupons cannot be used to buy Gift Vouchers or other Coupons, and cannot be exchanged or refunded for cash or credit

5. Qualifying Enterprise Customers who sign up / upgrade on BroadBand Connect Wireless Lite 20GB plan during the promotional period will receive a R500 Takealot.com coupon only:

• Customer to claim the coupon within one (1) calendar year and use the coupon within three (3) years

• Each Coupon can only be used once at checkout.

• Only one Coupon can be used per order

• The value of the Coupon will be set off against the value of the shopping basket and the balance remaining, if any, will be payable by Coupon holder

• If the full value of the Coupon is not used, the Customer will forfeit the remaining value of the Coupon.

• Coupons cannot be used to buy Gift Vouchers or other Coupons, and cannot be exchanged or refunded for cash or credit

6. Qualifying Enterprise Customers who sign up / upgrade to a Vodacom Business Data 20GB plan during the promotional period will receive a R500 Takealot.com coupon only:

• Customer to claim the coupon within one (1) calendar year and use the coupon within three (3) years

• Each Coupon can only be used once at checkout.

7. Only one Coupon can be used per order

• The value of the Coupon will be set off against the value of the shopping basket and the balance remaining, if any, will be payable by Coupon holder

• If the full value of the Coupon is not used, the Customer will forfeit the remaining value of the Coupon.

• Coupons cannot be used to buy Gift Vouchers or other Coupons, and cannot be exchanged or refunded for cash or credit

8. All vouchers and coupons are governed by the relevant terms and conditions supplied by the brand or store supplying the voucher.

9. The offer is not transferable and may not be substituted or exchanged for cash or anything else.

10. Should the full value of the offer not be used, the Customer will forfeit the remaining value of the voucher.

Eligibility

11. The Promotion is only open to natural persons 18 years and older. 

12. Any participant under the age of 18 shall present their parent / guardian’s written consent to redeem the shopping vouchers at Vodacom’s request.

13. Only entrants who are using SIM cards that have been RICA registered are eligible to get the prizes. Each owner of a SIM card(s) is responsible to comply with South African law by RICA registering their SIM cards.

14. Voucher codes will only be issued during working days and working hours (this excludes public holidays and weekends).

15. Employees, directors and agents of Vodacom and all participating stores, their immediate families, life partners, business partners and associates and any person directly involved with the sponsoring, devising, production, management or marketing of this Competition are not eligible to participate in this Promotion.

16. Customers must reside in South Africa and be in possession of a valid South African identity document or permanent residence permit or temporary residence permit valid for a period exceeding 3 (three) months for the Republic of South Africa and valid at the End Date.

17. In the event that the user of the mobile phone (i.e. the participant in the Promotion) is not the person that is responsible for payment of the participating mobile phone account/ charges, then the coupon will be allocated to the user. 

Valid Entry

18. In order to receive the shopping vouchers in the promotion, customers will be required to sign up or upgrade to a qualifying handset during the promotional period and qualifying entrants must sign up for, or upgrade to, any qualifying post-paid contract online during the promotional period.

19. Customers are allowed to upgrade/ sign-up on multiple contracts.

20. There are no additional charges for participating in the Promotion apart from the standard contract costs.

21. Vodacom shall not be liable for any costs incurred by the customer for participating in the Promotion or in claiming any prizes, where applicable. 

Winner Validation

22. All the information provided or related to this Promotion shall be managed, captured and approved by Vodacom.

23. Vodacom will share personal details of the respective customers such as name and contact number with the respective promotional agencies as set out in paragraphs 3 to 5 above, who will be sending respective customers their shopping vouchers and you hereby agree to such disclosure as is necessary to effect prize fulfilment.

24. Vodacom and /or the respective promotional agencies will use reasonable efforts to share the digital voucher codes within 7-10 days of customers signing-up or upgrading to a Vodacom contract

25. The claim for any shopping voucher will be subject to security and validation, and Vodacom reserves the right to withhold any prize until it is satisfied that the claim by a particular customer is valid.  The selected customers must be able to identify themselves, in a manner determined by Vodacom, as the qualifying entrants to the Promotion and have to comply with the required validation procedure, determined by Vodacom, in order to claim any prizes, failing which such winner will forfeit the prize 

26. Notwithstanding the fact that the prizes vest in the customers immediately upon the determination of the results, in the event that the required documentation from a particular customer has not been received at the agreed cut-off date communicated to the customer, or no effort is made on the part of any of the customers to make special arrangements to meet the deadline set by Vodacom, such prize will be forfeited. 

Prize Delivery

27. No voucher is transferable or exchangeable and may not be redeemed for cash.

28. All risks and ownership of the prizes shall pass to the winners on transfer/delivery thereof and hence all of Vodacom’s obligations in regard to the Promotion as well as in regard to the prizes shall terminate. 

Personal information

29. User data collected via the Promotion will not be used for any other purpose than for execution of the Promotion.

30. Vodacom respects the right to privacy and takes the protection of personal information seriously. Vodacom will only use personal information for the purposes of the Promotion as stated in these Terms and Conditions and in accordance with Vodacom’s Privacy Policy available on, https://myvodacom.secure.vodacom.co.za/vodacom/terms/privacy-policy

General

31. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participant or the promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").

32. In the event of a dispute in regard to any aspect of the Promotion and/or the Terms and Conditions, Vodacom’s decision will be final and binding and no correspondence will be entered into. 

33. Vodacom may refuse to award a prize if entry procedures or these Terms and Conditions have not been adhered to or if it detects any irregularities or fraudulent practices.  Vodacom is entitled in its entire discretion to reject any participant for any reason and will not be obliged to notify Customers that they are rejected.  

34. Vodacom and/or any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors and any of its personnel involved in the promotion, shall not be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Promotion or from claiming the prize. 

35. Vodacom is not liable for any technical failures affecting participation and / or prize redemption process of the Promotion.  In addition, neither Vodacom nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participating in and/or the prize redemption process of the Promotion.

36. Vodacom, its directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties, guarantees or undertakings given by any person other than Vodacom itself.

37. If Vodacom is required by law to alter or cancel any aspect of the Competition or to terminate it as a result of changes in legislation, or for any reason whatsoever, it will have the right to terminate the Competition being offered, with immediate effect and without notice. In such event all entrants hereby waive any rights which they may have against Vodacom and its associated companies, agents, contractors and/or sponsors. 

38. All information relating to the Competition which is published on any marketing material will form part of these Terms and Conditions. In the event of any conflict between such marketing material and these Terms and Conditions, these Terms and Conditions shall prevail.

39. The Competition is also subject to, and must be read in conjunction with, Vodacom’s existing terms and conditions applicable to its website and mobile site respectively.
